(“TERMS AND CONDITIONS”)

By accessing, browsing, and using the Poh Heng Jewellery e-commerce website (the “Website” or the “Site”), you acknowledge and accept these Terms and Conditions. Poh Heng Jewellery reserves the right to modify these Terms and Conditions at any time without prior notice. We recommend reviewing these Terms and Conditions periodically to stay informed about any changes.

By accessing, browsing, and using the Website, you acknowledge and accept the terms in this section 2.

a. Access and use of the Site are for personal use only and must comply with these Terms and Conditions. You agree not to use the Site for any unlawful purposes or in a way that violates these Terms and Conditions.

b. You are not permitted to reproduce, modify, distribute, or display any portion of the Site or its content for commercial purposes without the express written consent of Poh Heng Jewellery. This includes but is not limited to:

• i. Distributing any material that infringes the copyrights, patents, trademarks, trade secrets, or other proprietary rights of any person.
• ii. Republishing, archiving, or retaining any content on the Internet, intranet, extranet, database, archive, or compilation without express written consent from Poh Heng Jewellery.
• iii. Decompiling, reverse engineering, or disassembling any software or other products or processes accessible through the Site.
• iv. Using the Site in a manner that is illegal, impairs its operation, or affects its availability or usage by others.
• v. Employing any data mining, data gathering, or extraction methods in connection with your use of the Site.
• vi. Using the Site for the benefit of another business without prior written consent from Poh Heng Jewellery.

c. Poh Heng Jewellery may assign you a password and account for identification to enable you to access and use certain portions of the Site. You are solely responsible for maintaining the security and confidentiality of your password and account information and restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password. Notify Poh Heng Jewellery immediately if you suspect unauthorized use of your password or account or any other security breach.

d. We reserve the right to terminate your access and use of this Website and/or your account in our sole discretion for any reason, including a breach of these Terms and Conditions or if we reasonably believe that you have violated or acted inconsistently with these Terms and Conditions. Any failure or delay in terminating your access and use or taking any legal action does not constitute a waiver of our rights to enforce these Terms and Conditions.

By using the Site, you acknowledge that you have read and agree to the Privacy Policy and consent to our collection, use and disclosure of your personal data for the purposes as set out in the Privacy Policy.

Poh Heng Jewellery makes every effort to ensure the accuracy of product and pricing information on the Site. However, errors may occur, and Poh Heng Jewellery reserves the right to correct any errors in pricing or product information and modify or cancel orders affected by such errors at any time, without prior notice.

a. 24K/999 and 22K/916.6 jewellery carry Poh Heng’s mark, Singapore Assay Office (SAO) hallmark and fineness mark except for gold products that are less than 1 gram in weight.

b. Only Gold Bars weighing 10 grams and above are serialised.

a. By placing an order on the Site, you agree to pay the total amount due for your order, including any applicable taxes, shipping, and handling fees.

b. You represent and warrant that you have the right, authority, and capacity to accept and agree to these Terms and Conditions and enter into such an agreement with us. You also represent and warrant that you are authorized to use the payment method you provide, and that the information is accurate.

a. Poh Heng Jewellery makes every effort to deliver your order within the selected delivery date provided at the time of purchase. However, delivery times may vary due to unforeseen circumstances. If you request for the delivery date to be rescheduled or missed the delivery, a nominal fee of S$10 for standard shipping or S$30 for express shipping will apply.

b. If you opt for Self-Collection at our retail boutique, you may designate another person to pick up your purchased order. An Email Order Confirmation and an Authorisation Letter will be required at pickup. The authorised representative must bring his or her NRIC for verification purposes.

c. You may request for an Authorisation Letter template from Poh Heng Jewellery. The Authorisation Letter should be in hard copy and contain the order ID, name, signature and last 4 digits of NRIC of both the purchaser and authorised representative.

d. Poh Heng Jewellery will notify you when your order is ready for collection and send a reminder if the order remains uncollected by the selected date. Poh Heng Jewellery reserves the right to discard uncollected items within one month after the selected date, at our discretion.

e. Poh Heng Jewellery is not responsible for actions taken by your authorised representative once your item(s) has been picked up. Please review our Order & Shipping section in our FAQs for more information.

a. An order cannot be changed or amended by you once payment has been made. Further, an order cannot be cancelled once it has been processed and shipped (or once delivery has been arranged).

b. All orders are subject to Poh Heng Jewellery’s acceptance and availability. Poh Heng Jewellery reserves the right to refuse or cancel any order for any reason, including but not limited to, product availability, errors in the description or price of the product, or an error in your order.

c. Poh Heng Jewellery reserves the right to refuse or cancel any order if we suspect fraud, unauthorized or illegal activity, or if payment cannot be verified.

d. In the event that your order was cancelled by Poh Heng Jewellery, you will be notified by email or phone and a full refund of any payment received will be provided to your original payment method. Processing time may vary according to your payment provider.

Subject to the terms herein, goods sold are exchangeable at any of Poh Heng Jewellery’s boutiques within fourteen (14) days of purchase provided that the item remains in a new and unused state and condition (including in the original packaging). In the unlikely event that you have received a damaged or incorrect item, you must inform us and return the item in its original state and condition (including in the original packaging) within three (3) days of the date of delivery / collection.

In any event, the following terms apply:

• a. For an exchange to an item of a higher value, a top-up in the difference in price is required. For an exchange to an item of a lower value, there will be no refund of the difference in price given.
• b. Item(s) must be accompanied by its original receipt and (where applicable) certificate.
• c. Exchange of good sold will be calculated at the original purchase price.
• d. Sales/promotional items, special / customised orders, engraved jewellery, corporate items / gifts and sponsored items are not valid for exchange or refund.
• e. Exchanges made will require customer to return promotion vouchers or its dollar equivalent amounts, and/or any other privileges extended to customer as a result of the sale of the original item.
• f. No cash refund will be made.

Please note that we reserve the right to reject any returns that do not meet our return policy’s terms and conditions to the extent permitted by applicable laws. In such cases, the item will be returned to you at your expense. Please note that all exchanges or returns can only be done through our physical retail boutiques.

a. All prices listed on the Poh Heng Jewellery website are in Singapore Dollars (SGD) and are inclusive of Goods and Services Tax (GST).

b. We reserve the right to change the prices of our products at any time without prior notice.

c. We accept payment via credit card, debit card, or bank transfer. Payment must be received in full before an order is processed and shipped.

d. If a pricing error occurs, Poh Heng Jewellery reserves the right to cancel any orders placed at the incorrect price. If payment has already been made, we will provide a full refund of the amount paid based upon the original payment method.

a. Poh Heng Jewellery strives to provide accurate and complete descriptions and images of our products. However, we do not warrant that product descriptions or other content on the Website are accurate, complete, reliable, current, or error-free.

b. We make every effort to display our jewellery as accurately as possible, but colours and finishes may vary, given the viewing conditions and settings of screen devices may be diverse.

c. If you receive a product that does not match the description or images on the Website, please refer to our return policy for instructions on how to return the item.

You agree to indemnify, defend, and hold harmless Poh Heng Jewellery, its officers, directors, employees, agents, licensors, and suppliers (collectively the “Service Providers”) from and against all losses, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from or in connection to any violation of these Terms and Conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the Website using your account. This indemnification obligation will survive the termination of any relationship between the you with Poh Heng Jewellery and your use of the Website.

a. Poh Heng Jewellery makes no representations or warranties of any kind, express or implied, as to the operation of the Website or the information, content, materials, or products included on the Website.

b. To the full extent permissible by applicable law, Poh Heng Jewellery disclaims all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the Website, its servers, or emails sent from Poh Heng Jewellery are free of viruses or other harmful components. The Website is provided is provided “as is” and “as available” and without warranty of any kind.

c. To the full extent permissible by applicable law, Poh Heng Jewellery will not be liable for any damages of any kind arising from or related to: (i) the use or misuse of the Website, including but not limited to direct, indirect, incidental, punitive, and consequential damages; (ii) delay or inability to access or use the Website; (iii) any loss or corruption of data or information submitted via the Website; (iv) any information, communications or services provided by, or requested from Poh Heng Jewellery via the Website; (vi) property damage resulting from access to or use of the Website; and (vii) the product(s). This limitation is cumulative and will not be increased by the existence of more than one incident or claim. The foregoing limitations of liability shall apply regardless of whether the claim is based on warranty, contract, tort, or any other cause of action, and whether or not Poh Heng Jewellery has been advised of, or may have otherwise anticipated, the possibility of such damages. Notwithstanding the foregoing, the total liability of Poh Heng Jewellery for any reason whatsoever related to access to or use of the Website shall not exceed the total amount paid by you to us in connection with the subject matter of the particular dispute.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Singapore. Any disputes arising out of or related to the use of and/or purchase through the Site shall be subject to the exclusive jurisdiction of the Singapore courts.

These Terms and Conditions, together with any policies or guidelines posted on the Site, constitutes the entire agreement between you and Poh Heng Jewellery regarding the use of the Site and/or purchase via the Site. If any provision of this Agreement is held invalid or unenforceable, such provision shall be revised to the extent necessary to cure the invalidity or unenforceability, and the remainder of these Terms and Conditions shall continue in full force and effect. The failure of Poh Heng Jewellery to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.
